Acceptable Use Policy

1. Purpose and scope

This Acceptable Use Policy ("AUP") describes what you may and may not do when you use CROSSPAD, a product operated by Auren LLC, at https://crosspad.co. It forms part of the Terms of Service and the Commercial Beta Terms; capitalized terms have the meanings given in the Terms of Service. It applies to everyone who visits the Platform, creates an Account, uploads a Source File or places an Order, and to anyone acting on their behalf. If this AUP conflicts with the Terms of Service, the Terms of Service prevail.

2. Eligibility

To use CROSSPAD you must:

  • be at least 18 years old;
  • use the Platform for business or professional purposes. If you nevertheless purchase as a consumer, non-waivable consumer rights under the law of your habitual residence are not affected by this AUP;
  • give accurate, current information when you create an Account or place an Order, including your name, your business name where requested, and a verified email address you control; and
  • if you act for an organization, have authority to bind it to the Terms of Service and this AUP.

3. Prohibited content

You must not upload, enter or submit to the Platform:

3.1 Files you lack rights to. Any Source File or other Customer File that you do not own or are not authorized to upload, transform, store and have processed by Auren LLC and its subprocessors in the United States. Each upload includes an attestation of that authority, which is recorded with the Order.

3.2 Controlled defense and export-controlled technical data. During the Commercial Beta you must not upload:

  • technical data controlled under the International Traffic in Arms Regulations (ITAR, 22 C.F.R. Parts 120–130), including anything described on the United States Munitions List (USML);
  • classified information of any government, at any level;
  • technical data classified under an Export Administration Regulations (EAR) "600 series" or 9x515 Export Control Classification Number, or otherwise subject to an export-license requirement, unless you have first confirmed to us in writing that processing by Auren LLC in the United States, including by our personnel and subprocessors, is authorized under an applicable license or exception, and we have accepted the Source File in writing before upload.

3.3 Malicious or crafted files. Any file containing malware, or constructed to exploit, probe or degrade the parser, the processing worker or any other part of the Platform, including decompression bombs, path-traversal or symbolic-link payloads.

3.4 Infringing or misappropriated content. Content that infringes or misappropriates a third party's intellectual property or trade secrets, including a design you received under a confidentiality agreement or license that does not permit processing by a third-party service.

4. Prohibited conduct

You must not:

  • circumvent, disable or interfere with any limit, gate or control of the Platform, including file-size and Supported Scope limits, the Blocked verdict, rate limits, payment authorization and capture, or the sealing of a Delivery Bundle;
  • scrape, crawl, harvest or bulk-download any part of the Platform, or access it by automated means other than interfaces we provide for that purpose;
  • reverse engineer, decompile or disassemble the Platform, or systematically use Analysis results, migration reports, finding codes, validation manifests or Delivery Bundles to build, train, calibrate or benchmark a competing migration or conversion tool, except to the extent mandatory law permits (for example, for interoperability). Using your own reports and converted files for your own engineering work is never restricted;
  • share your Account or credentials, let another person use a one-time sign-in code issued to you, or request a one-time code for anyone else;
  • create Accounts by automated means, or create multiple Accounts to evade a limit, suspension or termination;
  • submit a Defect Report you know to be false, or present a disclosed item, a Scope Change or an Unsupported construct as a Material Defect;
  • initiate a payment dispute claiming the service was not provided or not as described when a Conforming Deliverable was Delivered, or when the Remediation Service was offered under the Refund & Remediation Policy, without first contacting support. Nothing in this AUP limits your right to contact your bank or card issuer, to raise a dispute you believe in good faith is legitimate, or to exercise any non-waivable statutory right;
  • test the security of the Platform except as described in the Security, File Retention and Deletion Policy; or
  • use the Platform in any way that violates applicable law, including sanctions and export-control law.

5. Sanctions and export compliance

5.1 Prohibited jurisdictions and persons. You must not access or use the Platform from, on behalf of, or for the benefit of anyone in Cuba, Iran, North Korea, Syria, or the Crimea, so-called Donetsk People's Republic or so-called Luhansk People's Republic regions of Ukraine, or any other territory subject to comprehensive United States sanctions; or if you, your organization or anyone you act for appears on a United States restricted-party list (including the OFAC Specially Designated Nationals list, the BIS Entity List and the Denied Persons List) or an equivalent EU or UK list, or is owned or controlled by a listed person.

5.2 Your classification duty. You are responsible for determining the export classification of every Source File you upload and for complying with the export-control and sanctions laws that apply to you, including the EAR, the ITAR and any non-US regime. Auren LLC does not classify your designs and does not give export-control advice.

5.3 What we may do. Auren LLC may block access, Account creation or checkout based on IP address country, card country or other signals; may ask you for information to verify eligibility, identity, business use or export status at any time; and may decline or cancel an Order if we cannot satisfy ourselves that the use is lawful. Doing so is not a breach of the Terms of Service.

5.4 Processing location. All processing takes place in the United States. If your own rules or export licenses prohibit processing of a file in the United States or by a US company, do not upload it.

6. Enforcement

If we reasonably believe you have breached this AUP, we may, in proportion to the breach and without limiting other remedies: warn you; suspend or restrict your Account or an Order while we investigate; refuse, cancel or stop processing an Order (Fee handling follows the Refund & Remediation Policy; where we stop an Order because of your breach of section 3 or 5, we may retain the Fee to the extent the law allows); remove, quarantine or delete Customer Files, including before the usual retention periods; preserve evidence with the Order record; terminate your Account; and report the conduct to law-enforcement, regulatory or export-control authorities where legally required, or where we believe in good faith that reporting is necessary to address unlawful conduct or a threat to any person or system.

We will tell you which provision you breached and, where the law requires, give you an opportunity to respond, unless doing so would be unlawful, would compromise an investigation, or would put another person or the Platform at risk.

7. Reporting abuse

If you believe someone is using CROSSPAD in breach of this AUP, email support@orkoottrae.resend.app with the Order Reference, Account email or URL concerned, a description of the conduct and any evidence. We acknowledge abuse reports within 3 business days. We may not be able to share the outcome of an investigation involving another customer.

8. Intellectual-property and trade-secret complaints

Customer Files are never published, but a design may be uploaded by someone without the right to do so. This section explains how a rights holder can notify us and how we respond. It is modelled on the elements of 17 U.S.C. § 512(c), adapted to a private processing service and to trade-secret claims.

8.1 Designated contact. Send complaints to legal@orkoottrae.resend.app or by post to Auren LLC, 30 N Gould St, STE R, Sheridan, WY 82801, United States.

8.2 What a notice must contain.

  1. Identification of the work, design or trade secret you claim is infringed or misappropriated; for a trade secret, a description sufficient to identify the material without disclosing the secret itself.
  2. Identification of the material on the Platform: Order Reference, Account email, or file name and approximate upload date, if known.
  3. Your name, organization, postal address, email address and telephone number.
  4. A statement that you have a good-faith belief that the use is not authorized by the rights holder, its agent or the law.
  5. A statement that the notice is accurate and, for copyright claims, that under penalty of perjury you are the rights holder or authorized to act for the rights holder.
  6. Your physical or electronic signature.

8.3 What we do on receipt. We (a) acknowledge the notice within 2 business days; (b) suspend processing and any pending Delivery for the identified Order and quarantine the identified Customer Files; (c) forward the notice, including your contact details unless you ask us to withhold them and the law permits, to the uploading Customer; (d) preserve the relevant Order records as evidence; and (e) delete the quarantined files under the retention schedule, or earlier if the uploading Customer does not respond.

8.4 Counter-notice. The uploading Customer may send a counter-notice to the same contact containing: identification of the material; a statement under penalty of perjury of a good-faith belief that the material was quarantined by mistake or misidentification, or that the Customer has the right to upload it; the Customer's contact details; consent to the jurisdiction of the United States District Court for the District of Wyoming (Customers outside the United States consent to that district); and a signature. We forward the counter-notice to the complainant. Unless the complainant tells us within 10 business days that it has filed a court action seeking to restrain the use, we may resume processing or restore access.

8.5 Repeat infringers. We terminate, in appropriate circumstances, the Accounts of Customers who are the subject of repeated substantiated complaints.

8.6 Misuse of this process. A person who knowingly makes a material misrepresentation in a notice or counter-notice may be liable for resulting damages under applicable law.

9. Changes

We may update this AUP and publish the new version at /acceptable-use with a new version number and effective date. For material changes we email Account holders at least 14 days before the effective date, except where a change is needed immediately to comply with law or to address abuse, in which case we notify you as soon as we can. Continued use after the effective date means you accept the updated AUP for future use; it does not change the terms of an Order already placed.
